CBS & Merlin Battle Over Slogans - 1/24 - From TRI radio biz newsletter: Is CBS violating the Lanham Act on an hourly basis, claiming that 1010 WINS is the "one and only all-news station"¯? Merlin Media raised that question last year, and now claims that CBS is still using a top-of-the-hour ID that ignores that fact that its "FM News 101.9"¯ WEMP debuted in August. That's the third point in a brief letter to CBS from Randy Michaels' attorney. Here's how the letter starts - "First, Merlin Media is not precluded by law from identifying its competitors and highlighting its competitive advantages in the marketplace." Second, Matthew Walch of Latham And Watkins says Merlin Media's occasional ad-libs of phrases like 'all-news, all the time' or 'we'll give you the world' do not infringe or otherwise violate any rights held by CBS." But the letter says "because these phrases are not significant in Merlin Media's advertising...[it] will endeavor to stop using them in the future." Then the letter hits point #3 - "Unlike Merlin Media, CBS has engaged in repeated violations of the Lanham Act by falsely advertising the services it offers at WINS." That's the "one and only all-news station" claim. It asks CBS to respond by today. Dan Mason didn't need that long. Shelley Kanther, 36, has filed a federal suit against KYW owner CBS Radio, alleging that she endured "severe and pervasive" sexual harassment while employed as director of marketing communications from April 2009 until August 2010, when she says she was illegally terminated in retaliation for her complaints about the station's work environment. Norman Corwin Dies - 10/19 - From AP: Norman Corwin, a creative giant of the Golden Age Of Radio whose programs chronicling World War II are milestones in broadcasting, has died. He was 101. Through the 1940s, his work ran the gamut from variety shows to dramas, comedies, to documentaries. He joined CBS in 1938. In 1941, he wrote "We Hold These Truths," a commemoration of the 150th anniversary of the Bill Of Rights that was broadcast simultaneously on all four radio networks days after the bombing of Pearl Harbor. In 1945, he penned "On A Note Of Triumph," which was broadcast the day of the allied victory in Europe. He wrote the first and final programs of a 26-part portrait of President Franklin Delano Roosevelt, titled "FDR," that aired on the ABC television network in 1963..... Nassau notes that it has positive cash flow. Last month, creditors owed more than $83.8 million filed an involuntary petition for Nassau's bankruptcy. The deal is worth $13 million per year. WCBS-AM has been the radio home of the Bombers since 2002. The station's "exclusive" negotiating window closed in April, allowing other outlets such as ESPN 1050 and WRXP-FM (now all-newser WEMP, 101.9) to make their pitches. Yankees suits are pondering their options, which could include the team taking its radio rights in-house and doing its own thing. Goldman said it's owed more than $69.8 million, Fortress made a claim for more than $11.2 million, according to the Chapter 7 petition filed in US Bankruptcy Court in Wilmington DE.
